Scope/modification of the terms of service
Please read the terms of service before using the service. The following General Terms and Conditions ("GTCs") shall apply to all present and future business, transactions, contracts and business relations, in any case and in particular also to transactions with/on online, on https://www.kocai.co.
These General Terms and Conditions apply both to consumers and to entrepreneurs within the meaning of the Italian Consumer Code (Legislative Decree no. 206 of 06/09/2005). Under Italian law, a consumer is defined as any natural person acting for purposes that are outside his or her trade, business, craft or professional activity. By creating the appropriate account on the website or subscribing to the newsletter, the user accepts these "GTCs" and declares his/her agreement with the content. The "GTCs" can be retrieved, downloaded, printed and stored.
This platform expressly rejects any deviation from the general terms and conditions on the part of the User. Differing or supplementary general terms and conditions of the User shall not become part of any contract, even if they have not been expressly rejected.

Registration/Login Data
In order to be able to use the services provided by www.kocai.co, the user undertakes to register on the platform by providing the latter with valid and truthful information in accordance with the registration form. The user will be able to use the services provided on the platform once registration has been successfully completed. This platform is entitled to reject users at their own discretion without giving reasons and to change any of the criteria for the registration at any time before concluding a transaction.
Site content and purpose
This site offers a simulation aimed at demonstrating the potential and features of a framework devised by Kocai through which to finance the restoration of works of art in exchange for the non-exclusive licencing of NFTs (non-fungible tokens) pertaining to the same works.
Since this is a simulation for demonstration purposes only, all functions proposed by the site do not in any way to determine any concession or transfer of rights even derivative or otherwise connected and/or related even indirectly to the works depicted.
Also all benefits, promotional offers, gadgets displayed on this site are not real, but mere simulations of the potential combinations and opportunities of the project designed by Kocai. No rights of a movable, tangible and/or intangible nature, therefore, may be claimed by users as a result or occasion of the use of www.kocai.co.
Disclaimer of Liability
While Kocai makes every effort to provide users with verified information and tools, Kocai shall not be responsible for errors or unavailability of functions and/or the presence of viruses on its website. Kocai makes every effort to ensure the accuracy and truthfulness of the information contained on the site and cannot be held liable for any damage resulting from the use of this site. Kocai reserves the right to remove or change this website at any time and without notice. Kocai cannot be held liable for any damage, including indirect damage, suffered by you as a result of your use of the site.

Specific conditions for the use of the website
For features requiring the creation of an account, users agree to open only one account. Users particularly agree and undertake not to engage, directly or indirectly, in criminal behaviour, such as hacking, spreading viruses, misusing the services provided by Kocai particularly for illegal or illicit purposes, identity theft or sending spam. Failure to comply with the above elementary rules of conduct authorises Kocai to intervene on its own initiative or upon request to take all necessary actions.

The direct or indirect references offered on the platform to external content (e.g. external links, banners or other information and advertising offers) are provided in the interest of the user. Applicable law and jurisdiction
These GTCs are exclusively subject to Italian law. In the event that in the place of residence of the user mandatory rules of application are provided for, that are necessary to the same and more favourable, the latter shall prevail. For any dispute concerning the interpretation and/or execution of this contract, the Court of Milan (Italy) shall have exclusive jurisdiction.
